ISLAMABAD: A legal expert has identified a “serious anomaly” in the 26th Amendment, a constitutional package passed by parliament, that could pose a challenge to the establishment of constitutional benches in the Supreme Court if it is not resolved by a 27th Amendment.
A former attorney general, who did not want to be identified, told The News that this provision must be changed through another constitutional amendment in order to create the new Judicial Commission of Pakistan (JCP) and to appoint constitutional benches due to the significant anomaly.
“In my view, until then the old benches will continue and there will be no constitutional benches,” he stated.
