On Friday, the Manhattan jury that is considering Daniel Penny’s case in the chokehold murder of Jordan Neely on a New York City subway last year announced that they were once again at a standstill on the manslaughter allegation.
Earlier that day, when the jury was unable to reach a decision on the second-degree manslaughter accusation, Judge Maxwell Wiley had told them to continue their deliberations. The defense lawyers for Penny protested and requested a mistrial due to the impassed panel of twelve Manhattanites.
After the jury initially reported being deadlocked, Wiley told the lawyers outside of the jury room, “It’s not time for a mistrial.”
