LONDON: Three judges of the UK’s Court of Appeal have accepted Altaf Hussain’s appeal against the ruling made more than a year ago by the Insolvency and Companies Judge Clive Jones, depriving Altaf of six London properties worth approximately £10 million in favor of the Pakistani faction. This decision is a huge relief to Hussain, the founder of the Muttahida Qaumi Movement (MQM), and a significant setback to MQM-Pakistan.
In his appeal of the single judge’s ruling to the Court of Appeal, Altaf contended that the judge overlooked fundamental details of how Dr. Farooq Sattar and other MQM leaders in Karachi took over his party and prevented him from rejoining the MQM following his August 22, 2016, speech and his subsequent voluntary ceding of authority to Dr Sattar and the Central Coordination Committee (CCC).The six properties in London belong to the actual and authentic MQM, which is based in Pakistan. According to ICC Judge Clive Jones, Syed Aminul Haque, the leader of the MQM and a former federal minister, had the right to make a claim against the Trusts’ properties.
Judges Lord Justice Arnold, Moylan, and Nugee of the Court of Appeal have reversed the decision made by High Court Judge Clive Jones on March 13, 2023, holding that MQM-P is MQM and that Altaf and his allies lack a legal defense in their capacity as trustees to contest the unconstitutional acts of MQM-P on August 31 and September 1, 2016.
