ISLAMABAD: Chief Justice of Pakistan (CJP) Yahya Afridi clarified on Friday that the Judicial Commission of Pakistan (JCP) lacked the authority to examine the 26th Constitutional Amendment.
According to The News, he stated while chairing a JCP meeting that the constitutional bench committee was given the authority to resolve cases pertaining to constitutional issues following the 26th Amendment.
Justice Syed Mansoor Ali Shah, a senior Supreme Court justice, had challenged the 26th Constitutional Amendment by suggesting that a full court be established to consider identical cases.
The majority of JCP members backed CJP Afridi’s position, according to sources with knowledge of the meeting’s procedures.
Prior to this, the panel unanimously agreed that creating rules to govern its process should be its top priority.
