Due to constitutional immunity against criminal proceedings granted by Article 248 of the constitution, the Islamabad Accountability Court on Tuesday dismissed criminal proceedings against President Asif Zardari in the Toshakhana car matter.
Advocate Farooq H. Naek, representing Asif Ali Zardari, submitted an application and prayed for the President’s constitutional immunity.
The judge of the Accountability Court ruled that Asif Zardari’s continued presidency of Pakistan was a prerequisite for hearing the Toshakhana car reference.
“No criminal proceedings whatsoever shall be instituted or pursued against the president or a governor during his term of office,” states Article 248(2). “No process for the arrest or imprisonment of the president or a governor shall issue from any court during his term of office,” states Article 248(3).
