Just minutes into Robert Costello’s evidence, Judge Juan Merchan ordered the jurors and press to leave the courtroom.
The former federal prosecutor, who has publicly chastised the prosecution’s key witness, Michael Cohen, irritated the court several times during his testimony.
Costello was heard making comments under his breath and continuing to speak after objections were sustained, indicating to witnesses that he should cease talking.
After excusing the jury, Merchan stated, “Mr Costello, I’d want to discuss basic decorum in my courtroom.
If you disagree with my decision when a witness is on the stand, you do not say ‘jeez’… You don’t give me the side look or roll your eyes.
