Bushra Bibi, the spouse of former prime minister Imran Khan, was ordered to be transferred from the Bani Gala sub-prison to the Adiala jail by the Islamabad High Court (IHC) on Wednesday.
In response to a plea filed by Bushra Bibi, asking to be transferred to the Adiala jail, where her husband is now doing time, IHC Justice Miangul Hassan Aurangzeb pronounced the reserved ruling.
After hearing the arguments, the supreme court had deferred its decision on May 2. Bushra Bibi could not be accommodated, according to the superintendent jail, as the facility was already overcrowded and had security concerns.
The notice designating Bushra Bibi’s Bani Gala residence as a sub-jail as “null and void” was also declared by the court.
Bushra was convicted in the notorious Toshakhana case and was subsequently placed under house arrest at her Bani Gala property on January 31. At the request of the superintendent of Adiala jail, the authorities had designated the Bani Gala mansion as a “sub-jail” in order to detain the former first lady.
Bushra had contested the government’s attempt to lock her up in Bani Gala to complete a 14-year sentence on February 6.
According to Khan’s wife’s appeal, she was prepared and willing to spend her sentence in the “Ordinary Jail Premises at Adiala Jail, rather than the declared sub-jail at her residence,” much like other party political activists.
