The North Carolina State Board of Elections was sued by the Republican National Committee (RNC) and the North Carolina Republican Party (NCGOP) for allegedly registering voters using a registration form that did not ask for identification, such as a Social Security number or identification card. According to the lawsuit, the Help America Vote Act was broken by enabling voters to register without proper identification.
On October 17, Chief District Judge Richard Myers decided to return some of the case to the state court after the State Board of Elections had transferred it to a federal court.
However, the 4th U.S. Circuit Court of Appeals overturned his decision on Tuesday, so the case will still be heard in federal court, with Myers deciding how to proceed.
In order to keep up with the Republican momentum, Dems must step up their early voting efforts.
