The court declared the dismissal null and unlawful and decided that Justice Shaukat Siddiqui will henceforth be deemed a retired judge.
The Supreme Court also overturned the Supreme Judicial Council’s recommendation against Justice Siddiqui, and the notification of his removal was deemed illegal.
“Unfortunately, due to the delay in the Supreme Court decision, Justice Shaukat Aziz Siddiqui has reached the age of superannuation,” the court’s ruling said.
It went on to say that Justice Siddiqui could not be reinstalled as a judge and should be declared retired.
Justice Siddiqui is eligible for all retired judge perks and benefits, according to the court, which also stated that a judge can be suspended for misconduct only after being given a fair trial.”Justice Shaukat Aziz Siddiqui was not given the opportunity to establish his claims. “He was dismissed for mere allegations,” the Supreme Court said.
