LAHORE: The Lahore High Court (LHC) has decided that, if paternity can be confirmed using accepted procedures, the biological father is liable for the kid’s financial support if the child was born out of wedlock or as a result of sexual assault.
According to the verdict, the biological father cannot deny financial obligation for the kid once paternity has been established under the law.
In a case involving the financial maintenance of a young girl whose mother had accused Muhammad Afzal of raping her in 2020, resulting in her pregnancy and the birth of a daughter, a written ruling was rendered to this effect.
Afzal was the subject of a first information report (FIR) filed under Sections 109 and 376 (rape).
