The historic Delhi High Court ruling followed a four-year legal dispute.
“We were extremely unfortunate to lose our son. But the court has given us a really important gift. The mother, Harbir Kaur, told the news that they will finally be able to get their kid back.
After Delhi’s Ganga Ram Hospital declined to disclose their son’s semen, which was kept in their fertility lab, in December 2020, Ms. Kaur and her husband, Gurvinder Singh, filed a petition with the court.
Preet Inder Singh, the couple’s 30-year-old son, was admitted to the hospital in June 2020 to receive treatment after receiving a diagnosis of non-Hodgkin’s lymphoma, a type of blood cancer.
Gurvinder Singh told the news that the hospital ordered him to save his semen before starting chemotherapy since the medication would negatively impact the quality of his sperm.
Unmarried Preet Inder consented, and on June 27, 2020, his sample was frozen. Early in September, he passed away.
When the bereaved parents asked to see their son’s frozen sperm a few months later, the hospital turned down their request. The Delhi High Court was then petitioned by the couple.
