Following claims that police and prosecutors concealed relevant information, Hannah Gutierrez, 27, who is almost six months into an 18-month sentence for the deadly shooting on cinematographer Halyna Hutchins’ set, had asked for a retrial or dismissal.
Judge Mary Marlowe Sommer, however, upheld Gutierrez’s conviction on Monday, stating that her attorneys had not been able to prove that the verdict would have been different had the evidence been accessible.
Additionally, Gutierrez’s request to be released from custody was denied by the New Mexico judge. She is presently pending in a higher court on an appeal of the conviction.
Actor Alec Baldwin faced an involuntary manslaughter trial earlier this summer.
After barely three days, the same judge dramatically discharged Baldwin because of doubts about the evidence.
On the Rust set in New Mexico in 2021, the actor was carrying a gun when it exploded, killing cinematographer Ms. Hutchins and injuring director Joel Souza.
The 66-year-old actor denied being involved in an involuntary manslaughter, arguing that other people on the scene were in charge of making sure the pistol was secure.
