ISLAMABAD: On Monday, Justice Jamal Khan Mandokhail of the Supreme Court raised concerns over the Army Act’s limitations on the power of military courts.
Salman Akram Raja, a distinguished attorney, argued on behalf of Arzam Junaid, the convicted defendant, in the intra-court appeal against the military trials of civilians before a seven-member constitutional panel presided over by Justice Amin-Ud-Din Khan.
Raja brought up the Brigadier (retd) FB Ali issue during the hearing, stating that the 1962 Constitution served as the basis for the ruling, which permitted civilians to be tried in military courts only when fundamental rights were protected.
How FB Ali, a civilian, was court-martialed under the same precedent was questioned by Justice Muhammad Ali Mazhar.
