ISLAMABAD: Justice Muhammad Ali Mazhar of the Supreme Court has noted that neither the military court nor the armed forces are a part of the judiciary, and no court decision explicitly states that the military court is a part of the judiciary.
His comments come as the federal government and defense ministry argued that the military trial of civilians was unlawful before a seven-member constitutional bench of the highest court, presided over by Justice Amin-ud-Din Khan, on Wednesday.
Justice Jamal Khan Mandokhail, Justice Mazhar, Justice Syed Hassan Azhar Rizvi, Justice Musarrat Hilali, Justice Naeem Akhtar Afghan, and Justice Shahid Bilal Hassan were the other members of the court.
