Irfan Haider, an ATC duty judge, heard the cases. The investigating officer informed the court that tests for voice matching, cell phone, photogrammetry, and video were required but could not be completed while Khan was being held on remand.
The investigating officer was advised to wait until after the holidays and appear before the administrative judge after the duty judge declined to hear the petitions.

Without receiving further order from the court, the investigating officer was forced to leave.
