ISLAMABAD: Justice Hasan Azhar Rizvi of the Supreme Court has questioned whether the offenses committed on May 9, 2023, are more serious than terrorist attacks.
His comments were made during the hearing of the intra-court appeal against the trial of civilians in military courts on Thursday by a seven-member constitutional bench of the Supreme Court, presided over by Justice Amin-ud-Din Khan.
Khawaja Haris, the attorney for the Ministry of Defence, stated during the proceedings that military courts were created under a different, recognized legislation and were not referenced in the Constitution’s Article 175 judicial system.
Justice Jamal Mandokhail responded by saying that while tribunals created under specific legislation have limited competence, courts created under Article 175 have extensive jurisdiction.
