Holmes received a sentence of over 11 years in jail.
She contested trial testimony and evidence in her appeal, arguing that statements made by her former romantic and business partner Ramesh “Sunny” Balwani regarding his degree of accountability for Theranos’ financial model ought to have been included. He spent more than 12 years behind bars.
The arguments were dismissed by the Ninth Circuit Court of Appeals.
Theranos’s assertion that it could do blood tests using a drop from a finger prick rather than a needle in a vein was described as “nothing more than a mirage” by Judge Jacqueline H. Nguyen.
In the Monday ruling, Nguyen wrote on behalf of a three-judge panel that “the grandiose achievements touted by Holmes and Balwani were half-truths and outright lies.”
