KARACHI: According to legal experts, the SC (Practice and Procedure) Amendment Ordinance is a “bad law” that undermines the goals of the original legislation by making the judiciary more polarized and reinstating subjectivity. Seniority will thereafter be marginalized, which worries them as well. However, some attorneys perceive some benefits from the modification, arguing that it lowers the possibility of delays or preferential scheduling by ensuring openness and consistency in case scheduling.
Asif Ali Zardari, the President, adopted the Supreme Court (Practice and Procedure) Amendment Ordinance 2024 on Friday. The chief justice and the two senior justices made up the three-member bench that was necessary to decide suo motu cases under the original Act.
