ISLAMABAD: Justice Mansoor Ali Shah, the senior puisne judge of the Supreme Court, has questioned the constitutionality of current benches until designated constitutional ones are formed, amid the general uncertainty surrounding the future of various cases in light of the constitutional benches issue.
During the hearings of a tax-related issue in the top court that was handled by a three-member bench that included Justices Ayesha Malik and Aqeel Abbasi on Monday, Justice Mansoor asked, “Until a constitutional bench is formed, are we unconstitutional?”
The judge’s comments follow the ruling coalition’s demolition of the 26th Amendment in the National Assembly and Senate last month, which provisioned, among other things, for the establishment of constitutional benches at the highest courts and the supreme court.
