The ruling in the case was reserved by the bench, which included Justice Mohsin Akhtar Kayani, Justice Arbab Muhammad Tahir, and IHC CJ Aamer Farooq, on March 30 of last year. On the other hand, Justices Kayani and Tahir posted their opinions—which were later deleted—on the IHC official website, arguing that the petition was not maintainable.
The high court clarified that the view of two justices could not be proclaimed the bench ruling and uploaded to the court website without the signatures of Justice Farooq, the leader of the bench.
IHC CJ Justice Aamer Farooq has resigned from the bench, and the IHC has now appointed a new bench. Despite having previously pronounced the petition non-maintainable, Justice Tahir will be joining the new bench.
