Yahya Afridi, the recently appointed Chief Justice, stated that he has given the SC Registrar a policy instruction about the referral of matters that need constitutional interpretation to the Constitutional Bench of the Supreme Court.
The ruling attempts to expedite the resolution of issues involving constitutional interpretation and legal legislation challenges.
Justice Shahid Waheed stressed the importance of sending the Haq Shifa case to the Constitutional Bench in Islamabad during a recent hearing, emphasizing the need for a careful interpretation of the relevant constitutional provisions.
In order to guarantee that cases needing constitutional interpretation are routinely moved with similar matters, the nominated Chief Justice Afridi has directed the Registrar’s Office to create a distinct category for cases that contest any statute.
The case was considered by a three-member panel presided over by Chief Justice Afridi.
