In a dispute concerning the seniority and transfer of judges from the Islamabad High Court (IHC), the Constitutional Bench of the Supreme Court issued its full decision on Thursday. It concluded that the president has the authority to transfer high court judges, but only under specific restrictions.
Justice Muhammad Ali Mazhar presided over the Supreme Court’s enlarged Constitutional Bench, which also included Justices Salahuddin Panhwar, Shakeel Ahmad, Shahid Bilal Hassan, and Naeem Akhtar Afghan.
Article 200 of the Constitution makes it abundantly evident that the president’s authority to move a high court judge from one high court to another is an independent article in its application.
