Disney’s ABC’s lawyer asked a federal judge on Tuesday to stop the Federal Communications Commission from reviewing the network’s broadcast licenses in advance, claiming that the regulatory action was started as payback for ABC’s content that offended the Trump administration.

In a roughly two-hour hearing in federal court in Washington, D.C., ABC contended that remarks made by President Trump and FCC Chair Brendan Carr revealed the real motivations behind the regulatory body’s historic decision to order eight television stations owned by ABC and its parent company in April.

FCC License Renewals Spark First Amendment Dispute

Initially, those licenses were supposed to be renewed between 2028 and 2031.They are using their governmental authority in retaliation to prevent ABC from using its First Amendment rights, according to Beth Wilkinson, the company’s lawyer.

Wilkinson once said that the FCC was essentially making the broadcast corporation sit with its “head on a guillotine” as it awaits a judgment about the licenses, using the French Revolution as an example.

ABC Warns of FCC Editorial Pressure

She stated that the regulatory action is having an immediate chilling impact on ABC’s editorial decision-making process. According to her, the FCC may “give us the corporate death penalty and take away our licenses” as a result of some of those rulings.

She cited a speech that Mr. Trump gave at the White House in July, in which he called for the revocation of ABC and NBC’s licenses and scolded them for failing to broadcast the address. She claimed that the comments constituted a “direct threat” to her client.

FCC Defends Early ABC License Review

“People may not like some of ABC’s coverage and the president is entitled to it, but the public has the right to be exposed to different speech and viewpoints,” she stated.

Disney’s inadequate response to an ongoing inquiry of the company’s diversity, equality, and inclusion practices, according to the Justice Department, which is defending the FCC, was the reason behind the agency’s decision in April to initiate an early license review.

One of the Justice Department’s lawyers defending the FCC in the lawsuit, Dimitar Georgiev-Remme, stated that ABC “refused to adequately respond” to the FCC’s anti-discrimination investigation.

ABC Challenges FCC Renewal Process in Court

The main focus of the legal arguments on Tuesday was whether Disney and ABC could legally contest the FCC’s early license renewal procedure in district court.

According to the Justice Department, a corporation would have to appeal an FCC order to the entire commission under the regulatory procedure that controls license renewals. A federal appellate court, not a U.S. district court, can thereafter hear any unfavorable ruling.

However, ABC claims that the kind of retaliatory behavior it is dealing with in this instance is outside the purview of the congressionally mandated regulatory appeals procedure.

ABC Says FCC Pressure Chills Political Coverage

Wilkinson cited the chat show “The View” as an example of how the network has altered its coverage of political issues.

She also mentioned that comedian Jimmy Kimmel, a longtime Trump opponent, independently uploaded his interview with Democratic Texas Senate candidate James Talarico to YouTube instead of broadcasting it on the network.

Wilkinson stated that the commission had the authority to handle the issue indefinitely, even if the corporation had attempted to challenge the April ruling to start an early license renewal.

Judge Questions FCC’s Early License Review

She added that ABC will not have a viable legal recourse to make up for the harm it has endured if the FCC finally chooses to renew the licenses at the conclusion of the process.

Biden-appointed U.S. District Judge Loren AliKhan sometimes seemed doubtful of the government’s assertion that the FCC started the early license renewal procedure to gather additional data for its anti-discrimination probe.

Georgiev-Remme was unable to respond right away when she asked the Justice Department what alternative legal means it may use to force ABC to give the necessary information.
