Alec Baldwin has filed two further moves to remove his involuntary manslaughter indictment.
Baldwin’s legal team submitted two moves: one to have the indictment dismissed with prejudice due to the state destroying evidence, and another to have it dismissed for failing to allege a crime. News was able to get both court filings, which were submitted on Monday.
Baldwin’s defense team contended that the prosecution has not proven the “30 Rock” actor has committed a crime. The prosecution acknowledged that there was a “prospect of live ammunition” on the “Rust” set, but his attorneys argued that this was “incomprehensible.” The complaint also stated that the armorer was in charge of making sure the rifle was free of live bullets.
