In September of last year, Erin Patterson was sentenced to life in prison for using a poisonous mushroom supper she served at her Leongatha, Victoria, home in 2023 to kill three family and attempt to kill another.

However, the 51-year-old claims she did not have a fair trial, pointing to issues with the evidence, the prosecution’s conduct, and an odd incident involving the jurors during their deliberations.

Erin Patterson Appeal Challenges Murder Convictions

Prosecutors will file an appeal of Erin Patterson’s sentence concurrently with the hearing of her case. The prosecution claims that the judge’s decision to allow Patterson to apply for parole after 33 years is “manifestly inadequate” and that the triple murderer should never be set free.

Erin Patterson did what?
In 2023, Patterson killed her 70-year-old in-laws Don and Gail Patterson as well as Gail’s 66-year-old sister Heather Wilkinson after feeding them separate servings of beef Wellington that included death cap mushrooms at her rural Victoria home.

For the triple killings, Erin Patterson, 51, was imprisoned last year.
Ian Wilkinson, a local pastor and Heather’s husband, survived the meal after spending weeks in the hospital, but the poisoning is still causing him health problems.

Patterson's Defence and Evidence

Simon Patterson, Patterson’s estranged husband, was supposed to attend the lunch but abruptly canceled, partly because he thought his wife had been trying to poison him for years.

Following the trial, it was discovered that he had fallen so severely ill after consuming many of her meals in the past that he had been in a coma, that a significant portion of his colon had been surgically removed, and that his family had been instructed to bid him farewell twice since it was unlikely that he would survive his illnesses.

Throughout the trial, Erin Patterson insisted that she had no intention of killing her family members and that everything had been a horrible accident, despite her attempts to conceal evidence and tell lies.

Patterson Challenges Evidence in Murder Appeal

Patterson will not be physically present for the appeal. She is serving her term at the high security Dame Phyllis Frost Center on the outskirts of Melbourne, and she has been selected to appear by video connection.

Her legal team submitted a three-page paper in November of last year detailing the points they intend to make in an attempt to get her sentence overturned.

Three judges will consider this appeal, which has seven reasons.

There are pieces of evidence that Patterson’s attorneys claim the jury shouldn’t have seen, such as mobile phone tracking information showing she had visited locations where death mushrooms had recently been observed.

Patterson’s side claims that all of the evidence was biased and irrelevant, leading to a serious injustice.

Patterson's Lawyers Challenge Trial Evidence and Jury Process

However, her attorneys contend that further evidence would have benefited Patterson in court. The defense claims that pictures and photos pertaining to her pastime as a longtime mushroom forager and bolstering their claim that the deaths were a terrible accident were improperly withheld.

They also have problems with the prosecution. Patterson’s team claims that they were inconsistent regarding a motive, hinting that there was one toward the conclusion of the trial while having stated at the beginning that they would not discuss a specific purpose.

They also take issue with the five days that attorney Nannette Rogers spent cross-examining Patterson. Watching the two argue in court, with Rogers accusing her of lying repeatedly, was uncomfortable at moments. “Unfair and oppressive” is how Patterson describes it.

Jury Hotel Stay Becomes Appeal Issue

Her lawyers, however, argue that further evidence would have helped Patterson in court. The defense alleges that images and photographs supporting their argument that the deaths were a horrible accident and relating to her long-standing hobby as a mushroom forager were unlawfully concealed.

They have issues with the prosecution as well. Patterson’s side argues that they were inconsistent about a motivation, implying one toward the end of the trial while having said at the outset that they would not address a particular objective.

Additionally, they object to the five days that lawyer Nannette Rogers spent cross-examining Patterson. It was unsettling at times to see the two dispute in court, with Rogers constantly accusing her of lying. “Unfair and oppressive” is how Patterson puts it.

What is the prosecution saying?

Last year, Judge Christopher Beale acknowledged that Patterson’s offenses were the worst of their type, but he claimed that the “harsh prison conditions” she endured had an impact on his decision to grant release after 33 years.

He pointed out that when she was sentenced, she had already been in solitary confinement for fifteen months. Meals are supplied via a tiny gap in the cell door, and inmates in solitary confinement are not allowed to socialize.

Because of the publicity surrounding her case, he said, there was a “substantial chance” that she would be detained in an isolation wing “for years to come” for her own safety.

What comes next?

Following these sessions, the appeal’s conclusion won’t be revealed right away because it can take months.

A retrial or an acquittal are the two possibilities if the Court of Appeal’s three justices decide to reverse her convictions.

Erin Patterson’s parole term may be extended beyond 33 years if the prosecution’s appeal is successful. She may possibly receive a life sentence without the possibility of release.
