FIRs against Sophia Mirza are quashed by IHC

Justice Arbab Muhammad Tahir of the high court invalidated the FIRs in 16-page judgment

ISLAMABAD: The Islamabad High Court (IHC) has quashed FIRs filed against actor Sophia Mirza by her ex-husband at the Secretariat Police Station in Islamabad.

In the case of Khush Bakht Mirza (actual name Sophia Mirza) vs. The State and Others, she sought dismissal of the FIR filed by her husband, Umar Farooq Zahoor, at the Secretariat Police Station in Islamabad.

In a 16-page decision, Justice Arbab Muhammad Tahir of the High Court struck out the FIRs.

According to the verdict, Zahoor is not permitted to file a FIR against the complainant in order to obstruct the legal proceedings that have already been launched against them.

The court concluded that the Police Officer in charge at the Secretariat, Islamabad, did not have the power to record cases for probing FIRs No. 36 and 40 of  2020 from P.S. CCC-FIA, Lahore. Hence, the registration of FIR No.465/2022 and 156/2023 at P.S. Secretariat, Islamabad, was declared unlawful.

The ruling held the In-Charge Police Station Secretariat and the Investigation Officer accountable, ordering a formal investigation to correct legal actions against the accused, Mirza.

It directed the Inspector General of Police, ICT, to look into any possible imitation of Zahoor’s involvement.

The judgment found that the FIRs were initiated in response to Zahoor’s application, despite investigations indicating that he was abroad at the time. The Inspector General of Police in Islamabad is tasked with conducting a thorough inquiry into misleading assertions about Zahoor’s whereabouts.

If Zahoor did really attend the station, the in-charge police station will be held liable for their failure to act.
