The experts cautioned that more legal challenges would follow from the Biden administration’s pursuit of widespread student debt forgiveness, saying it may be more politically motivated than legally justifiable. The Supreme Court invalidated Biden’s initial attempt to eliminate student debt last year. The plan called for the cancellation of about $430 billion in federal student loan balances and the loans of 20 million borrowers.
“Fundamentally, Congress ought to be the one making these choices,” said Anastasia Boden, head of the Robert A. Levy Center for Constitutional Studies at the Cato Institute.
