ISLAMABAD: Justice Athar Minallah of the Supreme Court stated on Tuesday that it is a “proven fact” that the Election Commission of Pakistan (ECP) misconstrued the ruling of the high court by which it was declared that the Pakistan Tehreek-e-Insaf (PTI) could not use its “bat” emblem because it had not conducted legitimate intra-party polls.

“Should the court uphold an unlawful interpretation made by a body established by the Constitution? Do you favor bringing back the necessity doctrine?” Justice Minallah said anything.

His comments coincided with the Sunni Ittehad Council’s (SIC) appeal against the Peshawar High Court’s (PHC) ruling that upheld the Election Commission of Pakistan’s (ECP) decision to deny them the reserved seats being heard by a 13-member full-court SC bench.

Is it appropriate for the court to support an unconstitutional interpretation made by a constitutional body? Would you like the idea of necessity to be revived?” Judge Minallah made a statement.

The Sunni Ittehad Council (SIC) was hearing a case against the Peshawar High Court’s (PHC) ruling that upheld the Election Commission of Pakistan’s (ECP) decision to deny them the reserved seats when he made his statements. The bench, consisting of thirteen members, heard the case.
