ISLAMABAD: The Lahore High Court’s (LHC) decision to declare a recount of votes in three National Assembly constituencies invalid, where Pakistan Muslim League-Nawaz (PML-N) candidates had prevailed, was overruled by the Supreme Court on Monday.
On the pleas submitted by the PML-N leaders, a three-member bench led by Chief Justice of Pakistan (CJP) Qazi Faez Isa rendered the reserved ruling by a majority of 2-1.
The top court’s Justice Aqeel Abbasi disagreed with the ruling that supported PML-N candidates Zulfikar Ahmed, Abdul Rehman Kanju, and Azhar Qayyum Nahra.
I believe that there is no factual error or legal defect in the contested judgments/orders issued by the LHC in the aforementioned Writ Petitions; hence, this Court does not need to intervene under Article 185(3) of the Constitution. Accordingly, the above civil petitions are dismissed and leave to appeal refused,” said the verdict.
