The Supreme Court of Pakistan (SC) made a significant decision on Friday, holding that Parliament’s legislative authority is limited to the parameters specified by the Constitution.
The 41-page ruling, written by Justice Mansoor Ali Shah in a matter pertaining to taxes, emphasizes that although Article 142 gives both Parliament and Provincial Assemblies the ability to enact laws, this authority is constrained by the express provisions of the Constitution.
It is evident from the ruling that legislation can only take place inside the parameters set forth in the Constitution. It emphasizes, in particular, that the rights guaranteed by Articles 9 through 28 of the Constitution cannot be eliminated by legislative action.
