Senate Votes Fauci Contempt Case
A US Senate committee has decided to punish former senior health official Anthony Fauci in contempt of Congress after he failed to answer questions during a hearing probing his management of the Covid-19 crisis.
The committee can now refer the case to the justice department for possible prosecution for disobeying a congressional subpoena after the vote.
Whether the department will pursue the case is still up in the air.
Fauci claimed that Kentucky Senator Rand Paul was attempting to put him “behind bars” during his testimony last week. Citing his constitutional right against self-incrimination more than 100 times.
Following the vote, Fauci’s attorney described it as a “crude political stunt” in a statement.
Fauci Faces Wuhan Lab Allegations
When this pandemic started in 2022, it had been the subject of a heated debate between public health experts like Fauci and President Donald Trump.
Senator Rand Paul has been accusing Fauci for years of trying to hide the epidemic’s origins. They are funding a research facility in Wuhan, China, where some believe it began as a result of a lab leak.
Most specialists believe that interaction with an infected animal is the most likely source of the pandemic.
Biden Pardon Shields Anthony Fauci
On the last day of his duty, former President Joe Biden granted Fauci a preemptive pardon, protecting him from federal prosecution for his acts from 2014 to 2025.
During that period, still, Fauci may still be charged with contempt of Congress and other offenses.
State or local charges that are not covered by the pardon may also be brought against him.
“We are deciding on whether this committee may order a witness who has been granted a federal pardon to testify.
The Top Democrat on the committee, Michigan Senator Gary Peters, defended Fauci. Accusing Paul of a “rushed investigation” and a “yearslong campaign” to prosecute Fauci.
Fauci has repeatedly denied any wrongdoing and last week accused Paul of having an “obvious obsession” with prosecuting him.
“The only conclusion I can reach is that the sole reason he is calling me before this committee is to get me to say something that could vindicate his repeated public pledges that I end up, in his words, ‘behind bars,'” Fauci said.
Paul, the committee’s Republican chairman, bypassed a full Senate vote on the contempt resolution. Saying he did not “want to waste time” going through the procedure.
Lawyer Defends Fauci Against Paul
Resolutions of contempt that are approved by the committee if it gets a 60-vote majority in the Senate. In the 100-member Senate.
Dr. Fauci’s attorney, David Schertler, urged the Senate to “reject Senator Paul’s meritless and politically-motivated contempt resolution” in a statement cited by US media.
Senator Paul has been telling everyone who would listen that Dr. Fauci ought to be charged and imprisoned for years,” Schertler continued.
“Dr Fauci has committed no crime — and Senator Paul knows it.”
Contempt Cases Remain Rare
In an email last week, lawyer David Schertler stated, “We are absolutely certain that Dr. Fauci has a valid Fifth Amendment privilege.”
Taking the Fifth is intended to shield people from pressure, errors, and an unjust shifting of the burden of proof of wrongdoing; it is not an admission of guilt.
Convictions and prosecutions for contempt are uncommon.
The first convictions since the 1980s occurred in 2024 when erstwhile Trump aides Steve Bannon and Peter Navarro were found guilty.
