Voting is a necessary part of living in a democracy, but the outcome of the election must be determined and verified by a number of processes.Votes are counted and results are tabulated during the “canvassing” process, which includes several checks and balances to ensure the validity of the election results.

By legally verifying the outcomes of the ballot counting and canvassing, the ministerial process known as “certification” brings the canvassing process to a close.

Where Specific state or jurisdiction needs verification.
When No specific date provided.
Who Is Involved Election officials, candidates, voters, and courts.
Current Status General overview of election procedures. No specific case identified.
Why It Matters Certification delays can affect the timeline for resolving election disputes.

Purpose of Election Certification

Certification is not intended to confirm that votes have been counted accurately, to identify irregularities or errors, or to address election-related issues; these are addressed by other processes. The election is validated once the results have been consistently verified throughout the canvassing process.

Refusing to certify an election is not legal

According to state regulations, certification is a ministerial obligation that must be fulfilled, hence county election officials cannot refuse to sign the certification documents.

The requirement for certification is not a coincidence. In direct response to previous political attempts to undermine certification in order to alter election results—attempts that both legislators and the courts recognized as a threat to democracy—it was written into law.

Furthermore, there are practical measures in place to guaranty that individuals who decline to certify are held responsible, either through criminal or civil penalties.

Mandatory Election Certification and Accountability

Since election denialism and conspiracy theories have grown since 2020, it is conceivable that some authorities may try to utilize refusal to certify to postpone the 2026 election’s completion if they don’t agree with the results.

Even if refusal is eventually ineffective, electoral conspiracists can achieve two goals by refusing to certify. First, it makes election conspiracy theories more prevalent and erodes public trust in our electoral system. Second, if candidates and state authorities are ill-prepared to react promptly, it may cause delays in the post-election process.
