China is increasing its focus on offshore wealth as authorities tighten tax enforcement and monitor capital held outside the country.

China Tightens Offshore Wealth Tax Rules

Chinese authorities introduced new rules in late July that impose a 20% tax on certain gains linked to offshore trusts.

The rules cover appreciation when investors transfer shares, property, or other assets into offshore trusts. Income generated by those trusts and the offshore entities they control can also face a 20% annual tax.

Tax offices in major cities, including Beijing and Hangzhou, have also started enforcing taxes on income from offshore insurance policies.

The changes have created uncertainty among wealthy investors who previously used offshore structures to manage assets outside mainland China.

Wealthy Investors Reconsider Offshore Trusts

The new rules have prompted some investors to review their existing trust arrangements.

Some are preparing cash to meet possible tax bills. Others are considering whether to unwind their trusts and change their investment structures.

Tax advisers say the new rules could create significant costs for people who maintain offshore trusts.

The issue is especially important for founders and major shareholders of Chinese companies listed overseas. Many used offshore trusts to hold wealth and access international, dollar based investments.

Billions of Dollars Could Be Affected

Consulting firm BCG estimated earlier this year that mainland Chinese ultra high net worth individuals hold as much as $1.2 trillion in offshore markets.

Those assets include investments in Hong Kong, Singapore, and other low tax jurisdictions.

A KPMG report found that more than half of China’s super rich individuals use offshore family trusts. That means the new tax rules could affect hundreds of billions of dollars in assets.

Some Investors May Sell Assets

Not every wealthy investor has enough cash available to pay a large tax bill.

Some assets remain tied up in property and other investments that cannot be sold quickly. As a result, certain investors may need to sell assets or borrow money to meet their tax obligations.

Some advisers have also reported that wealthy clients are considering selling mainland shares to raise cash.

At the same time, some investors are choosing smaller offshore asset managers instead of creating new trusts.

Tax Scrutiny Could Expand

The concern among wealthy Chinese investors goes beyond offshore trusts.

Reports have indicated that authorities have also started examining income from offshore insurance policies.

Bank of America analysts have suggested that tax enforcement could eventually extend to other forms of overseas income.

The broader campaign follows earlier efforts to tax gains from offshore stock trading.

Economists say the government is looking for additional sources of revenue as China’s property downturn reduces the income that local governments receive from land sales.

Greater Monitoring of Offshore Assets

Chinese authorities now have more tools to identify overseas financial assets.

The Common Reporting Standard has given Chinese tax authorities greater access to information about offshore financial accounts since its implementation in 2017.

Authorities can also use the Golden Tax Phase Four system to compare and cross check financial information.

This growing access to data could make it harder for wealthy individuals to keep overseas income outside the Chinese tax system.

China Tax Crackdown Reshapes Offshore Wealth

Wealthy Chinese investors are likely to continue reviewing their offshore structures as tax enforcement develops.

Some may declare their assets and pay the required taxes. Others could reduce their offshore holdings or unwind existing trusts.
