In a letter dated March 27, Housing Minister Jacob Young informed Conservative Members that Section 21 of the Housing Act would continue to grant powers until the legal system’s capacity to withstand the modifications had been evaluated.
The Renters Reform Bill was intended to be the means by which the mechanism would be eliminated, as promised in the Conservative 2019 platform.
Housing Secretary Michael Gove had already given signs that the government planned to back down from his pledge, but this new information confirms that laws will be amended.
However, Mr. Young’s letter stated as follows: “The government is taking substantial steps to deliver court improvement, including allocating £1.2m for court digitisation. It has also made it clear that Section 21 will be eliminated when the courts are ready.
However, we will now propose an amendment at the Commons report [stage] to mandate that, prior to the repeal of Section 21 for current tenancies, the Lord Chancellor publish an evaluation on the courts’ preparedness and obstacles to possession.
