The Missouri Supreme Court has ordered Secretary of State Denny Hoskins to explain why he is following a federal court order that keeps the 2025 congressional map in place. The clash has left election officials facing competing instructions from state and federal courts.

Missouri Map Fight Sparks Court Clash

Denny Hoskins, the secretary of state, has been summoned to appear in court on Thursday by the Missouri Supreme Court.

Hoskins is being asked by the court to explain why he instructed election workers to adhere to the congressional plan that Republican lawmakers had adopted in 2025.

The contempt motion was filed by People Not Politicians. In opposition to the 2025 map, the organization started the referendum campaign.

Hoskins has until Wednesday at noon to reply to the proposal.

The most recent development came when Justice Brett Kavanaugh of the US Supreme Court made a ruling. Missouri’s urgent desire to maintain the more recent congressional map was turned down by him.

Chief U.S. District Judge Stephen R. Clark quickly issued an order endorsing the 2025 plan. While the federal litigation is pending, his ruling instructs Missouri officials to keep using that map.

Why Missouri Faces Two Conflicting Court Orders

The dispute centers on two different court rulings.

The Missouri Supreme Court ordered officials to stop using the 2025 congressional map. It said Missouri should return to the map adopted in 2022.

The federal district court took the opposite position. Judge Clark said changing the districts after the August primary could create serious problems for voters and candidates.

Missouri already held its primary election under the 2025 map. Around 1.2 million people voted in that election.

Changing the map now could move some voters into different districts. It could also place candidates in districts where primary voters did not select them.

Missouri Congressional Map Fight Reaches Supreme Court

In September 2025, Missouri lawmakers approved House Bill 1. The state’s 2022 congressional map was superseded by the measure.

The law was eventually signed by Republican Governor Michael Kehoe.

The August 2026 primary in Missouri made use of the updated map.

People Not Politicians started a referendum campaign after lawmakers approved the plan. The organization wants voters in Missouri to choose whether or not the new districts should stay in place.

After that, the legal battle proceeded via many courts.

The Missouri Supreme Court prohibited state authorities from enacting or utilizing House Bill 1 on September 3. Rather, the court pointed the state in the direction of the 2022 congressional plan.

The U.S. Supreme Court heard a challenge to that ruling from Missouri officials. Emergency relief was denied by Justice Kavanaugh.

The Bigger Constitutional Fight

Missouri Republicans have raised several constitutional arguments.

One argument involves the Elections Clause of the U.S. Constitution. State officials say a referendum should not stop a congressional map approved by the legislature and governor before voters decide its future.

State officials also argue that changing district boundaries after a primary could create unequal treatment for voters.

The case also raises questions about the timing of court intervention in elections.

Courts often try to avoid major election changes close to Election Day. This concern is commonly linked to the Purcell principle.

Missouri officials have used that argument while asking courts to keep the 2025 map in place.

Missouri Map Fight Could Impact Elections Nationwide

The dispute could affect more than Missouri.

Election officials in other states may face similar legal battles over congressional maps. The case could help shape how courts handle redistricting disputes close to an election.

The timing creates another problem. Missouri has already completed its primary using the 2025 districts.

A sudden change could confuse voters. It could also create uncertainty for candidates and election administrators.

Election law scholar Edward Foley said higher federal courts may need to intervene to resolve the conflict between the state and federal orders.

Missouri Map Fight Heads Toward Key Court Ruling

Secretary of State Denny Hoskins must respond to the Missouri Supreme Court’s contempt motion by Wednesday afternoon.

He is also scheduled to appear before the state Supreme Court on Thursday.

Meanwhile, People Not Politicians is challenging Judge Clark’s order in federal court.

For now, Missouri election officials face an unsettled legal situation. The courts must determine which congressional map will ultimately govern the November election.

Missouri’s congressional redistricting fight has become a major election law dispute.
