US AI policy developments involving Washington, Congress, frontier AI, and cybersecurity

Artificial intelligence policy in the United States is entering a more active phase. In June 2026, the White House, Congress, and state lawmakers advanced several major AI initiatives.

The latest moves focus on frontier AI safety, national security, cybersecurity, AI generated content, research, and state regulation. Together, they could shape how companies develop and use advanced AI systems.

White House Moves Toward Frontier AI Oversight

President Trump signed Executive Order 14409, focused on advanced AI innovation and security.

The order calls for stronger cyber defenses across federal systems. It also creates plans for a voluntary government engagement process involving certain advanced AI models before public release.

Under the proposed framework, developers could give federal agencies access to qualifying frontier models for up to 30 days before wider release.

The order does not create a mandatory AI licensing system. Instead, federal agencies will develop classified benchmarks to identify models that fall within the framework.

The White House also directed the creation of an AI cybersecurity clearinghouse. The Treasury Department will coordinate the effort to identify and address software vulnerabilities.

National Security Agencies Prepare for Faster AI Adoption

The White House issued NSPM 11. The memorandum calls for faster AI adoption across the national security community.

The policy focuses on four areas: adoption, adaptation, assurance, and accountability.

It also calls for more advanced computing facilities and a national reserve of outside AI experts. The Defense Department must update its policy on autonomy in weapon systems and review it every year.

Another major provision targets vendor control. Commercial companies should not be able to disable, degrade, or materially change critical AI systems used by warfighters without government approval.

Congress Advances a Wider AI Framework

The House also moved toward a broader federal AI policy.

Representatives Jay Obernolte and Lori Trahan released a 269 page discussion draft called the Great American Artificial Intelligence Act.

The proposal covers frontier AI, workforce issues, cybersecurity, research, and international cooperation.

The proposal has not yet become law. Its sponsors are seeking feedback before moving forward.

House Committee Advances 10 AI Bills

The House Science, Space, and Technology Committee advanced 10 bipartisan AI bills.

The measures address AI research access, cybersecurity, federal data, model documentation, vulnerability reporting, content authenticity, workforce training, AI education, and data center energy use.

Many of the proposals give NIST and the National Science Foundation important roles. This suggests that federal agencies may play a larger part in developing future AI standards and research programs.

Senate Proposal Targets AI Generated Content

Senators Brian Schatz, John Curtis, and Mark Warner introduced the AI Labeling Act of 2026 on June 25.

The bill would require certain providers to attach visible and machine-readable disclosures to AI-generated images, video, and audio.

Large online platforms that meet specific user or revenue thresholds would also face content labeling requirements.

The Federal Trade Commission would enforce the proposed rules, while NIST would help develop technical standards.

Illinois Moves Toward Frontier AI Audits

Illinois has also taken a significant step.

The state legislature passed S.B. 315, known as the Artificial Intelligence Safety Measures Act. The bill would require annual independent audits for certain large frontier AI developers.

The proposal targets companies with more than $500 million in annual revenue that develop models above a specified computing threshold.

It would also require safety frameworks, pre deployment transparency reports, and reports on critical safety incidents within 72 hours.

The Illinois Attorney General would have enforcement authority under the proposal.

Why AI Policy Matters for Businesses

The growing number of federal and state proposals could create new responsibilities for AeI developers and other organizations.

Companies may ned to track model safety, cybersecurity practices, content labeling, third party audits, and reporting requirements.

State rules also remain an important issue. Different requirements could create compliance challenges for companies operating across multiple states.

The Next Phase of AI Policy

Federal lawmakers will continue reviewing the proposed AI framework and individual AI bills.

Federal agencies are also expected to develop further guidance under the White House executive actions.

In Illinois, the next major step will depend on the governor’s action on S.B. 315 and its proposed January 1, 2027 effective date.

Organizations using or developing advanced AI should continue monitoring these developments.

US AI Policy Enters a New Phase

The several important developments in US AI policy. Washington focused on national security, cybersecurity, research, transparency, and AI-generated content, while states continued developing their own rules.

For businesses, the key issue is preparation. Proposed federal rules and expanding state requirements could change how organizations develop, audit, document, and deploy AI systems.
