ISLAMABAD: The federal government was ordered by the Islamabad High Court (IHC) on Saturday to start and finish the process of dissolving the Capital Development Authority (CDA).
In the written ruling, Justice Mohsin Akhtar Kayani directed that the CDA’s assets and powers be turned over to the Metropolitan Corporation Islamabad (MCI).
The CDA’s Statutory Regulatory Order (SRO) concerning “Right of Way” and “Access Charges” was ruled invalid by the top court. The CDA’s acts under this SRO have all been ruled unlawful. The IHC also decided that the CDA had to return any money that was collected under this SRO.
“The SRO No.576 (I)/2015, dated 09.06.2015, is now deemed unlawful, beyond the scope of its power, and without jurisdiction.
