During a hearing on the review case of an employee from the Punjab Population Department, Chief Justice of Pakistan (CJP) Qazi Faez Isa offered some crucial remarks concerning the judiciary’s role in certifying unconstitutional measures, including martial law.
He expressed concern over prior judicial rulings that have, in his view, harmed the country’s legal and democratic structure. “It seems that the time has come to conduct classes for judges,” he said.
The top justice questioned the role of judges in enforcing the Constitution, saying that the judiciary’s prior support of martial law had “sunk the ship of the country”.
He questioned, “Are judges not bound by the Constitution?” emphasizing how the courts’ indulgence has permitted such careless and unlawful acts.
