Australian Court Finds Coles Misled Customers
Australia’s Federal Court has ruled that supermarket giant Coles Group misled customers by promoting fake discounts on hundreds of products. The decision marks a major development in Australia’s retail sector and could lead to heavy financial penalties for the company.
The case focused on Coles’ famous “Down Down” promotions. Australia’s consumer watchdog argued that the supermarket temporarily increased prices before advertising products as discounted items. According to the court, many of those promotions failed to offer real savings to shoppers.
Court Says Discounts Were Not Genuine
Justice Michael O’Bryan ruled that most of the sample discounts presented during the case were misleading. The court examined 14 products, including toothpaste, biscuits, and pet food. Out of those items, 13 promotions did not represent genuine price reductions.
The judge explained that retailers should sell products at the higher “was” price for at least 12 weeks before advertising a discount. Without that period, customers could wrongly believe they were receiving a special deal.
One product, Nature’s Gift Dog Food, did not breach the rules because the promotion did not display a previous “was” price on the label.
ACCC Took Legal Action Against Coles
The legal action came from the Australian Competition and Consumer Commission, commonly known as the ACCC. The regulator claimed that Coles misled shoppers on 245 products between February 2022 and May 2023.
The watchdog argued that ordinary consumers relied on promotional labels when making buying decisions. As a result, misleading pricing could influence shoppers to spend more money than intended.
Woolworths Also Facing Similar Investigation
Another major Australian supermarket chain, Woolworths Group, is also facing a similar court case. The ACCC accused Woolworths of misleading customers on 266 products over a 20 month period.
Both companies dominate Australia’s supermarket industry and control nearly two thirds of the national grocery market. In recent months, they have faced growing criticism over pricing practices, rising grocery costs, and competition concerns.
A final ruling in the Woolworths case is expected later this year.
Coles Responds After Court Decision
Coles stated that it is reviewing the court’s judgment carefully. The company said its main goal has always been to provide value to customers.
The supermarket also called for clearer pricing guidelines to help retailers avoid legal disputes in the future.
The court will decide financial penalties during later hearings. Experts expect the fines to be substantial because of the scale of the misleading promotions.
