The Supreme Court dismissed constitutional complaints brought by judges of the Islamabad High Court and others on Thursday, declaring in a landmark decision that the transfer of High Court judges is not unconstitutional.
Additionally, the court decided that Justice Sarfaraz Dogar could remain the acting chief justice of IHC.
However, the court remitted the matter to the Pakistani president for additional deliberation regarding the seniority of judges.
Justice Mohammed Ali Mazhar, who was in charge of the five-member constitutional bench that was considering petitions submitted by the IHC Bar Association, the Karachi Bar Association (KBA), and five IHC judges, among others, declared the ruling.
A constitutional challenge against the posting and transfer of judges between high courts was at the center of the dispute.
