The highest court in the state determined that the trial judge had unfairly biased the former film magnate by making “egregious” and incorrect decisions, such as permitting women to testify regarding charges that were unrelated to the case.
Weinstein was found not to have had a fair trial in a 4-3 ruling. The majority of the court stated that it was “an abuse of judicial discretion to permit untested allegations of nothing more than bad behavior.”
Judge Madeline Singas, one of the judges who dissented from the ruling, claimed the majority was “whitewashing the facts to conform to a he-said/she-said narrative”.
