On Monday morning, the Belfast High Court issued an order for the “disapplication” of certain act parts, citing their potential to weaken the protections for human rights that the region is granted under post-Brexit arrangements.
The government now has more authority to hold and deport asylum applicants who it believes entered the country unlawfully, according to the Illegal Migration Act. The plan to transfer asylum seekers to Rwanda lies at the heart of the new legislation.
The European Convention on Human Rights (ECHR), according to Mr. Justice Humphreys, is incompatible with some provisions of the Illegal Migration Act.
The government will file an appeal against the decision, according to Prime Minister Rishi Sunak, who also stated that the conviction “changes nothing about our operational plans to send illegal migrants to Rwanda this July or the lawfulness of our Safety of Rwanda Act.”
