Court Finds Parliament Acted Unconstitutionally
South Africa’s Constitutional Court has ruled that parliament acted against the constitution when it blocked impeachment efforts against President Cyril Ramaphosa in 2022. The judgment has reopened political debate and could lead to fresh impeachment proceedings in parliament.
The case was brought by opposition parties, including the Economic Freedom Fighters, led by Julius Malema. The court decision may now force lawmakers to reconsider whether impeachment should proceed.
Ramaphosa’s office responded by saying he respects the ruling and remains committed to the constitution, judicial independence, and the rule of law. The presidency also stated that he has cooperated fully with all investigations linked to the matter.
Opposition Calls for Resignation
Following the ruling, Julius Malema publicly called on Ramaphosa to step down. He argued that the president cannot focus on governing while also facing potential impeachment proceedings.
Malema also said that the process carries serious personal and political consequences for Ramaphosa. He urged him to prioritise the impeachment matter.
The Economic Freedom Fighters have also written to the Speaker of the National Assembly asking for clear steps on how parliament plans to act on the court decision.
Background of the Impeachment Debate
The controversy dates back to 2022 when an independent panel found that Ramaphosa may have a case to answer after a large sum of foreign currency was stolen from his farm. The money was reportedly hidden inside a sofa.
Questions were raised about where the cash came from. Ramaphosa denied any wrongdoing and said he did not act illegally.
At the time, parliament blocked impeachment proceedings. The African National Congress held a majority then, preventing the motion from advancing.
Political Landscape Has Shifted
Since the 2024 general election, the African National Congress no longer governs alone and now leads a coalition government. This shift could influence how parliament responds if impeachment is reconsidered.
Geordin Hill Lewis of the Democratic Alliance said political leaders must respect the rule of law. He added that the parliamentary committee responsible for impeachment must act fairly and follow constitutional procedures.
Presidency and ANC Response
The presidency reaffirmed its position that all allegations should be tested through proper legal processes. It stressed that no one is above the law.
The African National Congress echoed this view and said the ruling highlights the importance of independent institutions in South Africa’s democracy.
