A federal appeals court will hear arguments on Tuesday on Idaho’s stringent abortion ban and emergency treatment that made it all the way to the Supreme Court this year, in anticipation of a potential follow-up journey to the highest court.
The Biden administration’s arguments that federally funded hospitals must perform abortions when pregnancy complications endanger a woman’s life or health, even in places where the practice is illegal, will be heard by the 9th US Circuit Court of Appeals.
The abortion ban in Idaho, which has been partially halted and then reinstated several times over the legal process, provides an exception for situations in which a woman’s life is in danger, but not for situations in which her health is in danger but not to the point of death.
