Why wasn’t APS attack case trialled in military court despite Army Act: SC

"If civilian's crime is related to armed forces, trial will proceed in military court," says defence ministry's lawyer

ISLAMABAD: On Wednesday, the constitutional bench of the Supreme Court questioned the government about why, in spite of the Army Act’s existence and the connection between the crimes and it, the trial for the Army Public School (APS) attack was not held in a military court.

The judges also questioned whether terrorism trials in military courts required a constitutional amendment during the hearing on appeals against civilian prosecutions in military courts.

Khawaja Haris represented the Ministry of Defense in the intra-court appeal against the decision to trial civilians in military courts, which was heard by the constitutional bench presided over by Justice Amin-Ud-Din Khan.

Haris stated at the hearing that the location of the trial is determined by the nature of the offense.
