Four days after relocating to Nixon, Texas, in January 2022, Brandon Rasberry was shot and killed while dozing off at an RV park.
The body of the 32-year-old was found after he missed two days of work. He’d been hit in the head by a bullet.
The boy, who was seven years old at the time of the shooting and was unaware of Mr. Rasberry, cannot be charged with the crime due to his age, according to the Gonzales County Sheriff’s Office.
A child in Texas cannot be considered criminally responsible until they are ten years old. The child is being kept in juvenile jail for an unrelated incident after receiving evaluations at a mental health facility.
The victim’s father, Kenneth Rasberry, told the local news source: “This is a little boy, and I’m sure these case managers and counselors and all of that are going to pick that poor little boy’s brain apart for reasons that I’m sure.”
