ISLAMABAD: Chief Justice Munib Akhtar’s larger bench, which was leading the proceedings in his absence, registered his “protest” when he declined to join the five-member bench hearing a review petition that contested the Supreme Court’s decision on the defection clause under Article 63-A.
In his second letter to the registrar of the top court on Monday, Justice Munib said, “Four judges could not have sat and heard the matter that was listed before a 5-member Bench.”
It is important to note that Justice Amin-Ud-Din Khan, Justice Jamal Khan Mandokhail, Justice Mazhar Alam, and Justice Munib made up the initial five-member bench, which was presided over by Chief Justice of Pakistan (CJP) Qazi Faez Isa.
