ISLAMABAD: The scope of intra-court appeals was questioned by a judge who questioned whether the ICAs should be viewed as appeals or as simple internal reviews of the earlier decision, as the Supreme Court took up challenges to a five-member bench’s ruling on Monday that declared military trials of civilians illegal.
Justice Shahid Waheed, one of the seven judges on the Supreme Court bench, referred to Justice Syed Mansoor Ali Shah’s ruling in the Supreme Court (Practice and Procedure) Act 2023 and noted that the highest court should first resolve its jurisdiction before considering the fifty cases filed against the Oct. 23, 2023 ruling that invalidated the trial of civilians in military courts for their alleged involvement in the May 9 violence.
