ISLAMABAD: In a landmark decision, the Islamabad High Court (IHC) upheld the principle that transferred judges are exempt from taking a new oath when they join a new high court and denied a request to change the seniority list of judges.
Aamer Farooq, the Chief Justice of the IHC, made the ruling, which emphasizes the constitutional clauses that differentiate between the appointment and transfer of judges.
Three justices, Justices Sardar Muhammad Sarfraz Dogar, Khadim Hussain Soomro, and Muhammad Asif, were transferred to the IHC on February 1, 2025, which sparked the issue.
Prior positions held by the judges were in the High Court of Sindh, the High Court of Baluchistan, and the Lahore High Court, respectively.
