ISLAMABAD: On Friday, Justice Jamal Mandokhail questioned if army officers possess the necessary training and experience to sentence an accused person to death.
Under the direction of Justice Amin-Ud-Din Khan, a seven-member Supreme Court constitutional bench heard an intra-court appeal against civilian trials in military courts, during which he made his statements.
In a unanimous decision rendered by a five-member panel on October 23 of last year, the supreme court ruled that 103 individuals should be tried in civilian tribunals and ruled that civilian trials in military courts were invalid.
However, on December 13, 2023, a six-member highest court bench stayed its October 23 judgment on petitions against the earlier verdict, which was subsequently challenged. Justice Musarrat Hilali disagreed with the majority.
